By accessing or using the 1bi0 platform and services ("Services") provided by 1bi0 Technologies LLP ("Company", "we", "our", "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Services.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Services. By using our Services, you represent and warrant that you meet these requirements. If you are using the Services on behalf of a business or organization, you represent that you have the authority to bind that entity to these terms.
3. Account Registration
To access certain features of our Services, you must create an account. You agree to:
Account Responsibilities
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access or security breach
4. Description of Services
1bi0 provides a business automation platform that includes contact management, inventory management, billing and invoicing, website builder, messaging integrations (WhatsApp Business, Instagram), academy/LMS, AI-powered search and chatbots (1bi0.ai), and related tools. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time with or without notice.
5. Subscription and Payment
Access to certain features requires a paid subscription.
Billing
- Subscription fees are billed in advance on a monthly or annual basis
- All fees are non-refundable except as specified in our Refund Policy
- You authorize us to charge your payment method for recurring subscription fees
- Prices may change with 30 days advance notice
Payment Terms
You agree to pay all applicable fees and taxes. Failure to pay may result in suspension or termination of your account. We accept major credit cards and other payment methods as displayed on our platform.
6. Messaging Platform Terms
If you use our WhatsApp Business or Instagram messaging integrations, the following additional terms apply:
Meta Platform Compliance
- You must comply with Meta's WhatsApp Business Policy (https://www.whatsapp.com/legal/business-policy), WhatsApp Commerce Policy (https://www.whatsapp.com/legal/commerce-policy), and Instagram Platform Policy (https://developers.facebook.com/terms).
- You must have a valid Meta Business Portfolio (formerly Business Manager) and comply with Meta's business verification requirements.
- You are responsible for obtaining proper opt-in consent from recipients before sending WhatsApp messages, as required by Meta's policies and applicable laws.
- You must not use messaging features to send spam, unsolicited marketing without consent, or content that violates Meta's policies.
- Meta may restrict or revoke your messaging access if you violate their policies. We are not responsible for actions taken by Meta against your account.
Messaging Costs & Billing
- WhatsApp Business messaging uses Meta's conversation-based pricing model. Conversation fees are charged by Meta directly to your Meta Business account — 1bi0 does not charge additional fees for message delivery.
- Meta provides 1,000 free service conversations per month. Beyond this, costs vary by conversation category (Marketing, Utility, Authentication, Service) and country.
- You are solely responsible for maintaining a valid payment method in your Meta Business account and for all Meta messaging charges incurred.
- Instagram messaging does not currently have per-message fees from Meta, but this may change per Meta's policies.
- Our platform subscription fees (for the WhatsApp or Instagram modules) are separate from Meta's conversation charges.
Messaging Data Handling
- Messages sent and received through our platform are stored in our database to provide conversation history, analytics, and business continuity.
- Your Meta API access tokens are encrypted at rest (AES-256-GCM). We never share your tokens with third parties.
- You can disconnect your messaging accounts at any time from Settings. Disconnection preserves history but stops message flow.
- Full data deletion (including all messages and contacts) can be requested through Meta's data deletion process or by contacting us directly.
- We process messaging data as a data processor on your behalf. You remain the data controller responsible for your customer communications.
Messaging Limitations
- WhatsApp Business API has messaging limits based on your phone number quality rating and tier (1K, 10K, 100K, or unlimited messages per day).
- You can only initiate conversations with customers using pre-approved message templates. Free-form messages can only be sent within a 24-hour customer service window after the customer messages you first.
- Meta may impose additional rate limits, quality restrictions, or policy changes that affect messaging functionality. We will make reasonable efforts to adapt to such changes.
- Instagram messaging requires Advanced Access approval from Meta for the instagram_manage_messages permission. Standard Access has limited functionality.
7. AI-Powered Features Terms
Our platform includes artificial intelligence (AI) features including the 1bi0.ai search portal, per-business AI chatbots, and AI-assisted customer support. By using these features, you agree to the following:
AI Service Description
- 1bi0.ai is an AI-powered search portal that allows end users to discover businesses, products, courses, and services across the 1bi0 platform.
- Each business may have a dedicated AI chatbot (accessible at yourbusiness.1bi0.ai) that can answer customer queries using the business's own data.
- AI features may also be integrated into WhatsApp and Instagram messaging for automated customer responses.
- Core AI features use self-hosted, open-source AI models processed entirely on our infrastructure in India.
AI Accuracy Disclaimer
- AI-generated responses are provided for informational purposes only and may contain inaccuracies, errors, or outdated information.
- AI responses do NOT constitute professional, legal, medical, financial, or any other form of expert advice.
- You acknowledge that AI technology has inherent limitations and should not be solely relied upon for business-critical decisions.
- We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.
- You are responsible for verifying any information provided by AI features before acting on it.
AI Acceptable Use
- You must not use AI features to generate, distribute, or promote illegal, harmful, abusive, or misleading content.
- You must not attempt to manipulate, jailbreak, or exploit AI models to bypass safety measures or generate prohibited content.
- You must not use AI features for automated spam, phishing, or social engineering attacks.
- You must not reverse-engineer, extract, or attempt to access the underlying AI models or their weights.
- You must not use AI chatbots to impersonate real individuals, government entities, or emergency services.
AI Liability
- 1bi0 Technologies LLP is NOT liable for any actions taken, decisions made, or losses incurred based on AI-generated responses.
- Business owners are responsible for reviewing and monitoring AI chatbot responses provided to their customers.
- We are not liable for any inaccurate product information, pricing errors, or misleading responses generated by AI from your business data.
- If AI features are integrated with WhatsApp or Instagram, standard messaging platform terms and Meta compliance requirements continue to apply.
Premium AI Features
- We may offer premium AI tiers that use third-party AI models (such as Claude by Anthropic or GPT by OpenAI) for enhanced quality.
- Premium AI features may incur additional charges based on usage (per-query or per-token billing). Pricing will be clearly communicated before activation.
- When using premium AI features, your queries are processed by the respective third-party AI provider and are subject to their terms of service and privacy policies.
- You can opt out of premium AI features at any time and revert to self-hosted AI models at no additional cost.
AI Data & Content Ownership
- You retain full ownership of your business data that is used to power AI features.
- AI-generated responses are not claimed as intellectual property by 1bi0 Technologies LLP. However, they are also not guaranteed to be original or free of third-party intellectual property.
- We do not use your data to train or fine-tune AI models. Your data is only used at query time to generate contextual responses.
- You may request removal of your business data from AI search indexes at any time through your account settings.
8. Acceptable Use Policy
You agree not to use our Services to:
Prohibited Activities
- Violate any applicable laws, regulations, or third-party rights
- Upload or transmit viruses, malware, or other harmful code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of the Services
- Engage in fraudulent activities or misrepresentation
- Send spam, unsolicited communications, or bulk messages via WhatsApp, Instagram, or any other channel
- Send WhatsApp messages without proper recipient opt-in consent
- Use messaging features to distribute prohibited content as defined by Meta's policies
- Collect or harvest user data without consent
- Use AI features to generate harmful, misleading, defamatory, or illegal content
- Attempt to extract, reverse-engineer, or copy AI model weights or training data
- Use the Services for any illegal or unauthorized purpose
9. Intellectual Property
The Services, including all content, features, and functionality, are owned by 1bi0 Technologies LLP and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for your business purposes. You may not copy, modify, distribute, sell, or lease any part of our Services without written permission.
10. User Content
You retain ownership of content you upload or create using our Services ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive license to use, store, and process such content solely to provide the Services. You are responsible for ensuring your User Content does not violate any laws or third-party rights.
11. Data Protection
We process your personal data in accordance with our Privacy Policy. By using our Services, you consent to such processing. You are responsible for ensuring that your use of the Services complies with applicable data protection laws, including obtaining necessary consents from individuals whose data you process through our platform. This includes obtaining opt-in consent from recipients before sending WhatsApp or Instagram messages through our platform.
12. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. AI-GENERATED CONTENT IS PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND MAY CONTAIN ERRORS OR INACCURACIES. WE DO NOT GUARANTEE THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY AI-GENERATED RESPONSES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 1BI0 TECHNOLOGIES LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless 1bi0 Technologies LLP and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
15. Termination
We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination, your right to use the Services will immediately cease. You may terminate your account at any time by contacting us. Provisions that should survive termination will remain in effect.
16. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where 1bi0 Technologies LLP is registered.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our platform. Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms.
18. General Provisions
- These Terms constitute the entire agreement between you and 1bi0 Technologies LLP
- Our failure to enforce any right does not waive that right
- If any provision is found unenforceable, the remaining provisions remain in effect
- You may not assign or transfer these Terms without our consent
- No agency, partnership, or joint venture is created by these Terms
